Terms of Service

By using Pulled It you agree to these terms.

Welcome to Pulled It (“Pulled It”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of the Pulled It website at pulledit.shop and any related features, services, and content (collectively, the “Service”). Pulled It is operated by Derek Osmun.

By creating an account, accessing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18, you represent that you have your parent or legal guardian's permission to use the Service. The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

2. Your Account

You are responsible for:

  • Providing accurate information when creating your account.
  • Keeping your login credentials secure and confidential.
  • All activity that occurs under your account.
  • Notifying us immediately at support@pulledit.shop if you suspect unauthorized use of your account.

We may suspend or terminate accounts that violate these Terms, attempt to defraud other users, or misuse the Service.

3. User Content

The Service lets you create content including collection entries, want list entries, marketplace listings, profile information, and shared profile links (collectively, “User Content”).

You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and otherwise use it solely to operate and improve the Service. You represent that you have the right to grant this license and that your User Content does not infringe any third party's rights.

4. Card Data

The Service displays card data (names, images, prices, set information) retrieved from third-party APIs including the Pokémon TCG API, Scryfall, Lorcast, YGOPRODeck, and OPTCG API. All game names, card artwork, logos, and trademarks are the property of their respective owners (The Pokémon Company, Wizards of the Coast, Ravensburger, Konami, Bandai, and others). Pulled It is not affiliated with, endorsed by, or sponsored by any of these companies.

Card prices shown are estimates pulled from third-party sources and may not reflect actual selling or resale prices. We make no guarantees about the accuracy, completeness, or timeliness of card data or pricing.

5. Marketplace and Offers

The Service includes features that allow users to list cards for sale, make offers on other users' cards, and negotiate transactions. Pulled It is a listing and communication platform only. We are not a party to any transaction between users.

  • Buyers are responsible for evaluating listings, verifying card condition, arranging payment, and coordinating shipping with sellers.
  • Sellers are responsible for accurately describing cards, shipping in a timely manner, and honoring accepted offers.
  • Disputes between buyers and sellers must be resolved directly between the parties. Pulled It does not provide escrow, payment processing, or dispute resolution services at this time, unless explicitly noted for a specific feature.

We reserve the right to remove listings or suspend users for fraud, misrepresentation, or violations of these Terms.

6. Acceptable Use

When using the Service, you agree not to:

  • Post false, misleading, or fraudulent listings or offers.
  • Sell counterfeit, altered, or stolen cards.
  • Harass, threaten, or abuse other users.
  • Scrape, reverse-engineer, or use automated tools to access the Service beyond the rate limits we enforce.
  • Upload content that infringes intellectual property, is unlawful, or violates any person's rights.
  • Attempt to disrupt or compromise the security of the Service or other users' accounts.
  • Use the Service to send spam, malware, or unsolicited commercial communications.
  • Create multiple accounts to evade suspensions or manipulate the Service.

7. Subscriptions and Paid Features

If you purchase a subscription or paid feature (“Paid Features”), billing is handled by our third-party payment processor. You authorize us to charge the payment method you provide on a recurring basis until you cancel. Subscription fees are non-refundable except as described in our Refund Policy. We reserve the right to change pricing with notice.

8. Intellectual Property

The Service, including the Pulled It name, logo, design, and software code (excluding User Content and third-party card data), is the property of Derek Osmun and is protected by copyright and other laws. You may not copy, modify, distribute, or create derivative works without our written permission.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that card data and pricing will be accurate.

10. Limitation of Liability

To the maximum extent permitted by law, Derek Osmun and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or card value, arising out of or relating to your use of the Service — including but not limited to disputes between users, inaccurate pricing, lost sales, fraud by other users, or downtime.

Our total aggregate liability to you for any claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) $100 USD, or (b) the total fees you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold Derek Osmunharmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, your interactions with other users, or your violation of these Terms or applicable law.

12. Termination

You may delete your account at any time via the Service or by emailing support@pulledit.shop. We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service ends immediately, though sections that by their nature should survive (e.g. liability, indemnification) will continue to apply.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll post the updated Terms on this page and update the “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Washington, and you consent to their personal jurisdiction. You waive any objection to venue in those courts.
